Moving on military orders: the federal teaching-licence route, and what 11 state education agencies say about it

If your spouse’s military orders move your family to another state, federal law says your teaching certificate is valid there on three documents. Most of the state education agencies in this project do not say so on the pages a spouse would read, and some still print a condition the law removed in December 2024. Here is the law, and what each destination state publishes, quoted and dated.

The short version

Federal law (50 U.S.C. §4025a, amended 23 December 2024) makes a covered teaching certificate valid in the new state when the move is on military orders, on an application of three documents: the orders, the marriage certificate and a notarized affidavit.

The Justice Department says anything demanded beyond those items on the SCRA route is illegal — transcripts and test scores included — and that front-line staff have told spouses the route does not exist even when they asked for it by name.

On the pages we read: Georgia, North Carolina, Pennsylvania name the federal route; Georgia, North Carolina, New York still print a two-year condition the federal law dropped; the other 8 do not mention the federal route.

The federal route

A covered licence is valid in the new state
If a spouse holds a covered licence and the family moves because of the service member’s military orders, the licence is to be considered valid for the same scope of practice in the new state once the spouse applies.

The application is three documents
Proof of the military orders; a copy of the marriage certificate; and a notarized affidavit affirming identity, truthfulness, understanding of the new state’s requirements and scope of practice, and good standing in every state where a licence is or was held.
If the applicant is the spouse of a servicemember, a copy of the marriage certificate.

Nothing more may be demanded on this route
The Justice Department says a licensing authority may ask only for those items, and that demanding more on the SCRA route — transcripts or test scores, for example — is illegal.

There is no longer any requirement that the licence was actively used for a period before the move. The version of the law before 23 December 2024 required two years of active use.

Thirty days, or a temporary licence
If the agency cannot recognise the licence within 30 days of the application, it may issue a temporary licence with the same rights as a permanent one.

The interstate-compact exception Not settled — confirm with the agency
The route does not apply to someone who holds a licence to operate in multiple states under an interstate compact of the kind described in 10 U.S.C. §1784. Whether a teacher arriving under the Interstate Teacher Mobility Compact is caught by that exception is not established.

The teacher compact issues an equivalent licence in the receiving state rather than a privilege to practise in several states, which on its face falls outside the exception. No agency statement on the point was found.

The law is enforced
On 31 March 2026 the Justice Department settled with Georgia licensing boards over SCRA portability, with up to $3 million in compensation for servicemembers and spouses whose applications were improperly denied or delayed. Georgia’s teacher-certification commission is a party (see Georgia below).

A credential for the length of the service
CL-910 issues a spouse a credential comparable to a preliminary-level California credential, valid only while the military service lasts and not renewable.

California’s ordinary out-of-state route (CL-560) accepts an expired credential; this military route does not.

Colorado

The federal route on the agency’s pages
CDE’s Troops to Teachers page, read on 9 September 2026, does not contain the word “spouse”, and CDE’s educator-licensing pages read on 11 September 2026 do not mention military spouses or the SCRA.

The 2018 spouse exception
Colorado’s 2018 law let a military spouse count three years of experience within the previous seven instead of continuous experience.
The act exempts military spouses, as defined in the act, from the requirement that the teaching or special services experience be continuous, and instead requires 3 years of experience within the previous 7 years.

Overtaken for everyone in 2026
SB26-126, signed 21 April 2026, removed the seven-year window for every out-of-state applicant, so the 2018 spouse exception no longer gives a spouse anything other applicants lack. A guide still presenting it as a spouse benefit is out of date.

Florida

What we could not establish

Does the teacher compact trigger the federal exception? Unresolved
§4025a(e) removes the SCRA route from a spouse who holds a licence to operate in multiple states under an interstate compact described in 10 U.S.C. §1784. The Interstate Teacher Mobility Compact issues an equivalent licence in the receiving state rather than a multistate privilege, but no agency statement on the point was found.
